1. Acceptance of Terms
By engaging the services of Your Tax & Mortgage Services Pty Ltd (ABN 63 659 424 316), you agree to be bound by these Terms and Conditions. These terms govern the provision of all accounting, mortgage broking, and NDIS plan management services.
2. Services
We provide tax accounting, mortgage broking, and NDIS plan management services. The specific scope of services will be outlined in a separate engagement letter or service agreement provided to you before work commences. We will not commence any work until a signed service agreement is received.
3. Fees and Payment
Fees for accounting services are agreed upon before work commences and stated in our engagement letter. Invoices are payable within 14 days of issue. Mortgage broking services are provided at no direct charge to the client — we receive commission from lenders, which is disclosed in full. NDIS plan management fees are paid from your NDIS plan funding as approved by the NDIA.
4. Client Responsibilities
Clients are responsible for:
- Providing accurate, complete, and timely information
- Notifying us of any changes to your circumstances
- Reviewing and approving documents before submission to authorities
- Maintaining records as required by law
- Paying agreed fees within the stated timeframes
5. Limitation of Liability
Our liability for any claim arising from our services is limited to the fees paid by you for the specific service that gave rise to the claim. We are not liable for any consequential, indirect, or special damages. Our liability is also limited to the extent permitted by applicable professional standards and legislation.
6. Confidentiality
We maintain strict confidentiality regarding all client information. We will not disclose your information to third parties except as required to provide our services, comply with legal obligations, or as authorised by you in writing.
7. Termination
Either party may terminate the engagement with 14 days’ written notice. Upon termination, you are responsible for paying all fees for work completed to the date of termination. We will return all original documents provided to us.
8. Complaints
We are committed to resolving complaints promptly. Please direct complaints to admin@yourtaxservices.com.au. If not resolved to your satisfaction, tax complaints may be escalated to IPA or the Tax Practitioners Board; mortgage complaints to AFCA; NDIS complaints to the NDIS Quality and Safeguards Commission.
9. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Victoria.
